Terms of Service

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and The Deal Guy ("Company," "we," "us," or "our") governing your access to and use of the The Deal Guy website, Discord webhook notification services, and all related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, browsing, or otherwise using the Service, you represent and warrant that you have the legal capacity to enter into this Agreement and agree to comply with all applicable laws and regulations. If you do not agree to these Terms in their entirety, you are expressly prohibited from using the Service and must discontinue use immediately.

2. Description of Service

The Deal Guy provides a free notification service that alerts users to retail pricing errors, discounts, and promotional offers ("Deal Alerts") via Discord webhooks and community platforms. The Service is provided on an "as-is" and "as-available" basis. We make no representations or warranties regarding the accuracy, completeness, or timeliness of any Deal Alerts, nor do we guarantee that any advertised deals will be honored by third-party retailers.

3. License Grant

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to:

  • Sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available to any third party the Service or any content therein;
  • Modify, copy, or create derivative works based on the Service or any portion thereof;
  • Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code or underlying algorithms of any part of the Service;
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the Service.

4. User Obligations

You agree to use the Service solely for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service;
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected thereto;
  • Use any automated means, including bots, scrapers, or spiders, to access the Service;
  • Redistribute, republish, or resell Deal Alerts for commercial purposes without prior written consent.

5. Affiliate Disclosure

By utilizing the Service, you expressly acknowledge and consent that the Company may append affiliate tracking parameters to product links distributed through Deal Alerts. Such affiliate links generate commission revenue for the Company at no additional cost to you. The Company reserves the right to modify, suspend, or terminate the affiliate program at its sole discretion without prior notice.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

9. Termination

The Company reserves the right, in its sole discretion, to terminate or suspend your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service will immediately cease.

10. Modifications to Terms

The Company reserves the right to modify these Terms at any time in its sole discretion. Any changes will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes. You are advised to review these Terms periodically for any updates.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, which shall remain in full force and effect.
